A licensed practical nurse is facing life in prison if found guilty after being charged with rape by instrumentation or in the alternative sexual abuse by a caretaker.
John Wesley Tucker, 45, of Guthrie admitted to the sexual acts to an Oklahoma State Bureau of Investigations agent, but says it was consensual.
The female victim in the case is reported to be in her 30’s with a terminal illness. She is a resident at the Crescent Care Center where Tucker worked as a LPN.
According to an affidavit, the alleged crime occurred while the female was asleep in her bed when she awoke to Tucker conducting sexual acts. The court document says the patient yelled to wake up her roommate. Afterwards, the statement says Tucker gave her a morning pill and her shot of insulin.
The OSBI agent says a rape kit was obtained and the DNA matched that of Tucker. The report indicates the probability of selecting an unrelated individual at random from the population having his DNA profile was at least 1 in 48.2 quintillion. The victim was excluded as a possible donor.
Tucker’s bond was set at $50,000 on Friday afternoon and is expected to be back in court on April 24
