Trenary fails to appear, again: bench warrant not sought

12:10 p.m. – Guthrie News Page has just learned that Jay Trenary was arrested in Oklahoma County this week.

Trenary was scheduled to be in a Logan County courtroom on Tuesday, but did not show.

Trenary was given a $4,000 bond and afterwards filed a protective order in Oklahoma County against his girlfriend Lindsey Nicole Young, who was also arrested.

For the third time in less than two months, attorney Jay Trenary failed to appear in front of a judge. However, this time a bench warrant was not sought after.

Trenary was scheduled to be in front of Special District Judge R.L. Hert, Jr. on Tuesday morning for a review on new evidence that Trenary proclaims he discovered after his trial concluded.

It is uncertain why Trenary was unable to make it to court. A bench warrant was not served, but taken under advisement until July 5 at 2 p.m.

Trenary was found guilty this past April for obstructing a Guthrie police officer. The six-member jury set a punishment of $500.

Trenary was scheduled to be in court on May 14 for his trial sentence, but did not appear at 9 a.m. and a bench warrant was taken under advisement. Trenary was later seen that afternoon arriving at the courthouse shortly after 3 p.m. and requested a continuance in front of Judge Hert. Instead, he was ordered to appear in Payne County two days later (May 16) to meet with the court and the district attorney’s office to discuss sentencing dates.

However, he failed to show and the court then ordered a bench warrant in the amount of $500.

On May 22, Trenary made the motion for a new trial and an evidentiary hearing, but the judge denied the motion for a new trial. However, the judge order the court to hear the newly discovered evidence, despite objection by the State.

Trenary did not want to disclose or share the new-found evidence that he discovered to protect his case. He said he could have as many as up to 15 witnesses.

“The evidence is shocking and the court needs to be aware of it,” Trenary said in court.

Trenary has one other case still pending in the system after his second arrest this past April. He faces three misdemeanor charges, including disturbing the peace, resisting an officer and obstructing an officer.

The case will be in front of District Judge Phillip Corley after Judge Hert, who over saw Trenary’s first trial, disqualified himself from the Trenary proceeding due to a relationship with one of the parties.
