Trenary: I have found shocking and deeply troubling evidence

Attorney Jay Trenary told a judge Tuesday morning inside the Logan County Courthouse that he has found “shocking” and “deeply troubling” evidence in his trial case and wanted another trial.

Trenary, who once worked at the Attorney General’s office, was found guilty of obstructing an officer (misdemeanor) in late April by a six-member jury. He was issued a punishment of a $500 fine. Related story: Attorney found guilty on one of two charges; fined $500

The sentencing punishment has been delayed since May 14 when Trenary failed to show on two separate occasions. A bench warrant was issued for his arrest. Related story: Attorney fails to appear twice; arrested for third time in 11 months

On May 22, Trenary made the motion for a new trial and an evidentiary hearing, but on Tuesday the judge denied the motion for a new trial. However, the judge will allow the court to hear the newly discovered evidence, despite objection by the State, on June 26 at 9 a.m. for a status conference.

Trenary did not want to disclose or share the new-found evidence that he discovered this weekend to protect his case. He said he could have as many as up to 15 witnesses.

“The evidence is shocking and the court needs to be aware of it,” Trenary said in court.

The State requested the motions be denied and the sentencing to continue despite what they called the “11th hour” findings by Trenary, who is representing himself.

Trenary requested more time (August 20) because of his attorney schedule with trials for other clients, including one person facing murder and molestation charges in Oklahoma County. The judge set the hearing for July 5 at 2 p.m.

The Oklahoma Bar Association has been following the court proceedings with representatives inside the courtroom, including the trial, but was not seen in the courtroom on Tuesday.

The bar association, if they so choose too, could take action on Trenary’s status as an attorney, but can not do so until a judgement and sentence have been handed down.

Trenary has one other case still pending in the system after his second arrest in April. He faces three misdemeanor charges, including  disturbing the peace, resisting an officer and obstructing an officer. The case will be in front of District Judge Phillip Corley.
