Ponca City company files suit against Logan County, commissioner

A Ponca City company filed a lawsuit against the Logan County Board of County Commissioners and District 1 Commissioner Marven Goodman. The center piece of the suit surrounds two custom-built desks.

Court papers show Darrel Dye, doing business as Southwest Business Products LLC, filed the suit on Monday at the Logan County Courthouse.

In the suit, the Ponca City based company says on June 30, 2015 the commissioner’s office purchased furniture and furnishings, but has rejected the deliveries of the furniture. The court document goes on to say the company has attempted several times to receive payment.

The company is asking for a sum of $5,632.90.

In those comments, Dye stated his company was given a purchase order from the county to order two desks, which were measured specifically for the District 1 office. Dye says once the furniture was in the process of being delivered, they got a call from the county to cancel the order.

“We advised the county that we couldn’t cancel the order, that its special order furniture and that it was already on its way here. We were told the county was not going to accept this,” Dye told the commissioners.

Dye further stated, “Our concern is that a PO (purchase order) is a contract. That’s how we view it as and what the state views it as. We feel, that in good faith, we carried out our end of the bargain, but the county is refusing so far to accept the furniture and pay for the furniture.”

No comments were made by any of the commissioners and soon after Logan County Asst. District Attorney Glen Hickerson, County Clerk Troy Cole and the commissioners went into executive session for approximately 30 minutes to discuss the topic in the Feb. meeting.
